These Terms & Conditions (“Terms”) govern your use of gigbook.io and the GigBook application (the “Service”) operated by GigBook (“we”, “us”, or “GigBook”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into binding contracts to create a venue, entertainer, or production pro account. Fans under 18 may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information when registering and to keep your profile information current. You may have one account per role; venue owners may invite team members through the Service.
GigBook is a platform that helps venues, entertainers, and production pros find each other, communicate, and manage bookings. GigBook is not a party to any booking agreement between a venue and an entertainer. Each booking is an independent contractor relationship directly between the venue and the entertainer. GigBook does not employ, represent, or guarantee the work of any entertainer or venue on the Service.
Pay terms, timing, and method are agreed between the venue and the entertainer. Payments processed through the Service are handled by Stripe. GigBook offers subscription plans for premium features; subscription fees are billed by Stripe and are non-refundable except as required by law or as stated in the plan description. GigBook does not charge a commission on individual bookings unless a commission is expressly disclosed for a given feature.
RapidFill is an optional feature that helps venues fill last-minute openings by notifying available entertainers, and may include a HeroBonus added to base pay. Participation is voluntary for both parties. Entertainers can opt out of RapidFill offers in their profile settings at any time.
Users may leave ratings and reviews based on genuine experiences. You agree not to post false, misleading, or retaliatory reviews, and not to offer or accept incentives in exchange for ratings. GigBook may remove reviews that violate these Terms or that it reasonably believes are fraudulent.
The Service, including its design, text, graphics, logos, and software, is owned by GigBook and protected by intellectual property laws. You retain ownership of content you upload (photos, audio, video, rider documents) and grant GigBook a license to display and use that content within the Service for the purpose of operating your profile and bookings.
Disputes between a venue and an entertainer about a booking are primarily between those two parties. GigBook may offer tools (such as a dispute process) to help, but is not responsible for the outcome of any booking or the conduct of any user. Chargebacks should be a last resort; we encourage resolving disputes through the Service first. Abusive or fraudulent chargebacks may result in account suspension.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. GigBook does not warrant that the Service will be uninterrupted, error-free, or secure, or that any booking will be completed as agreed.
To the maximum extent permitted by law, GigBook shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenue, arising out of or related to the Service or any booking made through it. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or one hundred dollars, whichever is greater.
You agree to indemnify and hold GigBook harmless from claims, damages, and expenses arising out of your use of the Service, your breach of these Terms, or your conduct toward other users, including in connection with any booking.
You may close your account at any time. GigBook may suspend or terminate your account if you violate these Terms, if we are required to by law, or if we believe your conduct harms the Service or other users. Upon termination, your right to use the Service ends, but provisions that by their nature should survive will remain in effect.
You can cancel a paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until then. No partial refunds are issued for unused time within a billing period unless required by law.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved in the courts having jurisdiction where GigBook is established, unless you are a consumer with mandatory rights in your country of residence.
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
